What Is a Single Expert Report in Family Law?

When families are involved in proceedings before the Federal Circuit and Family Court of Australia, the Court may appoint a psychologist to assist in understanding the needs of the children and the capacity of each parent to meet those needs. This psychologist is known as a Single Expert Witness, and their report — commonly referred to as a Single Expert Report or Family Report — forms an important part of the Court's decision-making process.

A Single Expert Witness Psychologist is appointed by agreement between the parties or by Court order and serves as an independent expert. Their duty is not to any individual in the proceedings, but to the Court itself and to assisting the Court in determining arrangements that promote the best interests of the child.

Single Expert Witness Family Law Reports by Dr Heather Gan

The Single Expert Witness Family Law service at The Psychology Alley is provided by Dr Heather Gan, Clinical Psychologist and founder of the practice. Dr Gan integrates her doctoral research in children’s development, clinical psychology training, and culturally informed practice to provide careful and balanced family law psychological assessments for the Court.

As a family report writer, Dr Gan prepares independent psychological reports to assist the Court in understanding the needs of children and the family dynamics relevant to parenting arrangements. These reports are commonly referred to as Family Reports, Single Expert Reports, or family court psychological reports.

Each family law report is prepared with care and professional rigour. Dr Gan typically interviews each parent individually and meets with the children in an age-appropriate and child-sensitive manner. Depending on the type and scope of the report, the assessment process may also include structured observations of parent-child interactions.

Where appropriate, information may also be gathered from schools, medical practitioners, and other professionals involved in the family’s life. The resulting report provides the Court with independent clinical observations and recommendations focused on the best interests of the child.

Dr Gan is bilingual in English and Mandarin and has extensive experience working with families from Asian and cross-cultural backgrounds. While assessments are conducted in English, her cultural and linguistic background can support clearer understanding of family dynamics where culture plays an important role.

Referrals for Single Expert Witness reports and family law assessments are accepted from solicitors, Independent Children’s Lawyers (ICLs), and by Court order. Dr Gan welcomes referrals from family lawyers across Sydney and Australia.

Family Law Reports: What Does Dr. Gan Prepare?

  • A comprehensive psychological assessment prepared in response to specific questions (the Terms of Reference) agreed upon by the parties or directed by the Court. As a family report writer, Dr Gan conducts individual interviews with each parent and the children, reviews relevant documents, and may consult with collateral sources such as schools, medical practitioners, or treating clinicians.

Parents can generally expect to be interviewed on two occasions during the assessment process. This structure allows interviews to be conducted in a thoughtful and manageable way, and provides an opportunity for follow-up questions, clarification of matters raised during the assessment, and further elaboration on issues discussed in earlier interviews.

The assessment process also includes observations of parent-child interactions, which assist in understanding the child’s relationship with each parent and how parenting is experienced in practice.

The resulting family court psychological report addresses matters such as parenting capacity, the children's developmental needs, the impact of the parental dispute on the children, and recommendations for future care arrangements.

The assessment is conducted in accordance with commonly accepted family law forensic assessment practices, including review of Court material, interviews with each parent and the children, observations of parent–child interactions, and consideration of relevant collateral information where appropriate. The report addresses the Terms of Reference set by the Court and provides clinical observations to assist the Court in determining arrangements that promote the best interests of the child.

  • A Child Impact Report prepared by a psychologist is typically a shorter, more focused assessment used to inform the Court ahead of interim hearings. It centres on the children's current experiences, the impact of the separation and any associated conflict, and the children's expressed needs and wishes.

A Child Impact Report psychologist may be engaged earlier in proceedings when an expedited assessment is required. The report provides the Court with a grounded understanding of how the children are currently functioning and how the family circumstances may be affecting their wellbeing at that point in time.

  • Dr Gan may be engaged to conduct mental health assessments in family law matters where the Court requires psychological input regarding an adult party’s mental health and its potential relevance to parenting capacity or family functioning. The assessment typically involves a clinical interview with the individual and review of relevant material provided to the expert, conducted in accordance with the Terms of Reference set by the Court. The resulting report provides the Court with an overview of the individual’s psychological functioning and addresses the matters raised within the Terms of Reference.

  • Where the Court requires an expert opinion on a particular discrete matter - such as the impact of a proposed relocation, a child's resistance to spending time with one parent, or concerns about a specific parenting practice - Dr Gan can prepare a Specific Issues Report addressing the relevant Terms of Reference.

These reports assist the Court in obtaining focused psychological input on a particular issue that has arisen within the proceedings.

What Does the Assessment Process Involve?

If you or your client are engaged in Single Expert Witness family court proceedings, understanding what to expect can help ease some of the uncertainty. The process typically involves the following stages:

1. Referral and engagement

A referral is made by the parties' legal representatives or by Court order. Dr Gan will confirm her availability, provide her fee schedule, and supply the necessary documentation for the Terms of Reference to be finalised.

2. Document review

Dr Gan reviews the relevant Court documents, affidavit material, and any existing reports (such as those from family consultants or treating clinicians) that have been provided in accordance with the Court's orders.

3. Interviews with parents

Each parent is interviewed separately as part of the assessment process. These interviews provide an opportunity for parents to discuss matters relevant to the Terms of Reference and to provide information about the family circumstances.

4. Interviews with children

Dr Gan meets with the children in a manner suited to their age and stage of development. Depending on the type and scope of the report, structured observations of parent-child interactions may also form part of the assessment process.

5. Collateral contact

Where the Court's orders permit, Dr Gan may contact relevant third parties — such as teachers, general practitioners, or counsellors — to gather additional information about the children's functioning.

6. Preparation of the report

A thorough, carefully written psychologist report for Family Court is prepared, addressing each of the Terms of Reference and providing clinical observations and recommendations. The report is provided to the Court and the parties in accordance with the agreed timeframe.

7. Availability for cross-examination

Dr Gan is available to give evidence at trial if required. Her role throughout is to assist the Court impartially, and she approaches her evidence accordingly.

Professional Background

  • Dr Gan holds a PhD in Clinical Psychology. Her doctoral research examined parental socialisation and its relationship to children's moral emotions, moral self-concept, and social behaviour. The research focused on the measurement of children's moral emotions and how parenting practices may relate to children's developing sense of self and behaviour within social contexts.

This academic background informs Dr Gan’s understanding of children’s developmental experiences within family relationships, which can be relevant when considering how children experience parenting and family dynamics.

  • Dr Gan is fluent in English and conversational in Mandarin. She has particular experience with families from Asian or cross-cultural backgrounds, and brings a nuanced understanding of diverse parenting values, intergenerational family dynamics, and cultural context to her work as a family report writer.

  • As a Single Expert Witness psychologist in family law, Dr Gan's duty is to the Court, not to any party. Her assessments are conducted with integrity, clinical rigour, and scrupulous impartiality.

  • This is a forensic assessment service provided exclusively by Dr Gan. Reports are not prepared by, or delegated to, other clinicians within the practice. Referring practitioners and families can be confident that the assessment is undertaken by the named expert from beginning to end.

  • Dr Gan conducts her interviews in Sydney CBD, accessible for families throughout the inner city and greater Sydney region. Telehealth options may be available for certain aspects of the assessment process where appropriate and where permitted by the Court.
